Terms of Service

1. Scope

These Terms of Service apply to the use of the FlatReady platform, operated by Softure UG (haftungsbeschränkt). By registering, you accept these terms.

2. Nature of Service

FlatReady is a digital technology platform that enables tenants and landlords to discover each other and communicate directly. Softure UG is NOT a Makler (real estate agent) within the meaning of § 34c GewO. We do not broker apartments, negotiate lease agreements, or act on behalf of either party. All rental agreements are entered into directly between the tenant and the landlord without involvement of FlatReady.

3. Description of Services

FlatReady provides the following platform features:

• Creation of tenant and landlord profiles
• Browsing and discovery of profiles and listings
• Secure document upload and management
• Direct communication between tenants and landlords

4. Registration

Using the platform requires registration with truthful information. You are responsible for the security of your login credentials. We reserve the right to suspend accounts for false information.

5. User Obligations

As a user, you agree to:

• Provide truthful information
• Not publish misleading or fraudulent content
• Respect the rights of other users
• Not use automated access to the platform
• Comply with applicable laws

6. No Guarantee of Results

FlatReady does not guarantee that any user will find an apartment or a tenant. The platform provides tools for discovery and communication. The outcome depends on the actions of the users themselves, market conditions, and other factors outside our control.

7. Fees and Payment

FlatReady charges platform access fees for premium features. These are NOT brokerage commissions. All prices are displayed on the website and include VAT. Payment is processed through our payment service providers. Invoices are sent by email.

8. User Responsibility

Users are solely responsible for verifying the identity and claims of other users before entering into any agreement. FlatReady does not guarantee the accuracy of information provided by users. Users should independently verify all information, inspect properties in person, and seek legal advice before signing rental agreements.

9. Relocation Services

VIP plan users may access relocation assistance services (Anmeldung assistance, utilities setup, moving coordination, etc.). These services are provided as a convenience and do not constitute professional legal, tax, or immigration advice. FlatReady is not liable for the outcome of any third-party relocation services.

10. Verification Disclaimer

"Verified" status means a user has uploaded identity documents and their profile has been reviewed by our team. Verification confirms that the person is real and their documents are consistent. It does NOT constitute a background check, creditworthiness assessment, or endorsement. FlatReady does not guarantee the reliability, solvency, or suitability of any user.

11. Refund Policy

Premium and VIP plans include a 14-day money-back guarantee on platform access fees. To request a refund, contact us within 14 days of purchase. Refunds apply to platform access fees only. Any third-party relocation services already rendered under the VIP plan are non-refundable. Refunds are processed within 14 business days.

12. User-Generated Content

You retain rights to your uploaded content but grant us a license to use it within the platform. We reserve the right to remove content that violates these terms or applicable law.

13. Intellectual Property

All rights to the platform, including design, logos, and software, belong to Softure UG. Use beyond the intended purpose is not permitted.

14. Liability

FlatReady is a platform provider, not a party to rental agreements between users. We are not liable for the accuracy of user information, the quality of any property, the conduct of any user, or the success of any rental arrangement. Our liability is limited to intent and gross negligence in the provision of our platform services.

15. Termination

You can delete your account at any time. We reserve the right to terminate accounts for violations of these terms. Upon termination, unused paid services are forfeited, subject to the refund policy in Section 11.

16. Changes to Terms

We may change these terms at any time. Changes will be announced by email or on the platform. Continued use after changes take effect constitutes acceptance.

17. Applicable Law

German law applies. The place of jurisdiction is Berlin, where legally permissible.
